If atheism is a religion, as many insist, then don't atheists get the same rights as believers?

I personally consider it to be a lack of religion, but many True Believers insist otherwise. If so, then don't atheists get the same legal rights as other religions? Like having tax-exempt status for atheist organizations? Or getting an atheist symbol on your gravestone if you're a military vet?
